01. What these cover

These terms apply to your use of optiaitech.com. By using the site you accept them. If you do not, please stop using it.

They are not the terms of an engagement. Work we do for a client is governed by a separate signed proposal or statement of work. Where that agreement and this page differ, that agreement applies.

02. Business use

This site describes services sold to businesses. Nothing here is offered to consumers for personal, family or household purposes.

03. What this site is, and is not

The site is information about what we do. It is not an offer capable of acceptance, not a quotation, and not advice you should act on without talking to us.

We try to keep it accurate and current, but we do not warrant that it is complete, error-free or continuously available.

Opswake is not generally available. It is being prepared for early clinic pilots. Nothing on this site is a commitment to a release date, a feature, or a price.

04. Sending us an enquiry

Sending an enquiry does not create a contract and does not oblige either of us to do anything. We may decline work, and we often do.

Please do not send us confidential information, credentials, production data, or personal data about your patients, customers or staff through the form. If something needs to be shared in confidence, tell us and we will agree how first.

Anything you do send us that is not marked confidential, we may use to understand and respond to your enquiry. See the Privacy Policy.

05. Acceptable use

You agree not to use this site to break the law, infringe anyone’s rights, attempt unauthorised access, interfere with its operation or security, scrape it at a rate that degrades it for others, or submit content that is unlawful, misleading or harmful.

We may restrict access where we reasonably believe any of the above is happening.

06. Intellectual property

The content, design, code and marks on this site belong to OptiAI Tech Private Limited or our licensors. You may read, quote and link to it normally. You may not copy the design or substantial parts of the content for your own commercial use without our written permission.

Ownership of work we build for you is dealt with in the agreement for that work, not here. In general, deliverables built specifically for a client transfer to that client, and we keep the general methods, know-how and reusable components we brought with us.

Third-party names and marks that appear on this site belong to their owners, and their appearance does not imply any partnership or endorsement.

07. Links to other sites

Where we link to a site we do not control, we are not responsible for it. A link is not an endorsement.

08. Liability

Nothing in these terms limits liability that cannot be limited by law, including for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

Subject to that: we provide this website on an “as is” basis; we exclude implied warranties to the extent the law allows; and we are not liable for any loss arising from your use of, or reliance on, this website, including lost profits, lost data, business interruption or indirect or consequential loss.

Our liability in connection with an engagement is dealt with in the agreement for that engagement.

09. Privacy

How we handle personal data is set out in the Privacy Policy, which forms part of these terms.

10. Changes

We may update these terms. The date at the top reflects the current version, and using the site after a change means you accept it.

11. Governing law

These terms and any dispute arising from them are governed by the laws of India, and the courts at Pune, Maharashtra have exclusive jurisdiction.

If any part of these terms is found unenforceable, the rest continues to apply.
